The purpose of this BLAWG is to cover important current developments in both civil and criminal law in New York. Both substantive and procedural developments are covered. Primarily this will be accomplished by digesting recent cases in the State appellate courts. When appropriate, decisions of the Federal Courts will also be discussed. In addition, however, legislative and regulatory changes will also be covered. This service is intended to reach the legal practitioner and members of the general public seeking legal news and access to legal information. It is a fundamental philosophy of this publication that legal information should be easily accessible to all and free. This service is also intended to act as a forum where I and others may comment on legal developments with the intent of advocating for laws and a legal system which are less complex, less costly, and better serve the interests of society.
A brief bio about me. My name is Thomas Swartz. I am a graduate of Brooklyn Law School having graduated in 1989. Following law school, I spent 14 years as a court attorney with the Appellate Division, Second Department. My time at the Second Department was rewarding as I had the opportunity to make recommendations and draft decisions in literally thousands of appeals. It also was at times a frustrating experience having seen how frequently the litigation process has become too complex, lengthy, costly, and for lack of a better word "petty." Always more interested in the fundamental principles and philosophy underlying the law than the practice thereof, this publication is my attempt to contribute to the legal world.
