The court DIDN'T decide this on summary judgment.

This was an appellate court that reversed the summary judgment of a lower court.

And when they speak of what is and is not "abhorrant" to public values or whatever, NY State law explicity defines that which is abhorrant.

The Justices cannot and should not profess to know what the general populace feels, nor would it be responsible for them to issue judgments based on what their perceptions of public opinion are. And to suggest that they should is ludicrous. It paves the way for the majority to oppress the minority.

The justices simply issued their decision based on existing NY State law.

Keep in mind that NY is one of the few states that has not passed a "mini-DOMA," nor has there been any attempt to do so.

In fact, NY's governor introduced legislation to legalize same-sex marriages -- a bill which was passed in the assembly but has not yet made it through the senate.

Hardly sounds like it's considered an "abhorrence" now, does it?
